SARB: Public protector in league with presidency

The South African Reserve Bank (Sarb) has accused Public Protector Busisiwe Mkhwebane of conspiring with the Presidency and the State Security Agency to attack the central bank and undermine its authority.

The details are contained in a new affidavit filed on Monday which reveals Mkhwebane met with the two parties to discuss amending the Reserve Bank’s constitutional mandate just weeks before she released her Bankorp report.

Mkhwebane released her findings in June.

The remedial action to amend the Constitution has already been set aside by the High Court.

The Reserve Bank’s Johannes de Jager says that in the run-up to its main Bankorp review application, the Public Protector has disclosed numerous records of proceedings, including documents which were previously deemed confidential.

They show that just two weeks before Mkhwebane released her final report, she met with the Presidency’s legal advisor where the remedial action to change the Reserve Bank’s constitutional mandate was discussed.

No other party, including the Reserve Bank, was privy to this aspect of the report prior to its release.

It's also revealed that Mkhwebane met with the State Security Agency.

The notes reveal that during the meeting, the question was posed on how are they vulnerable.

De Jager says that this shows that the matter had turned from investigating the CIEX report to an attack on the Reserve Bank.

He has asked Mkhwebane to explain herself in a follow-up affidavit.
